Obama order poses dilemma for illegal immigrants

The Obama administration's announcement Friday that it would defer deporting most young illegal immigrants poses a dilemma for those who are eligible, as they?must take a leap of faith that they won't jump to the head of the line for deportation if a future president rescinds the order.

Under the order,?the Obama administration wouldn't?seek to deport?illegal immigrants under 30 who entered the?U.S. as children and meet certain other residency and education requirements?for the next two years. They also would be?eligible to apply for work permits, the Department of Homeland Security said. DHS is the parent agency of the Bureau of Immigration and Customs Enforcement.

The order could apply to as many as 800,000 young illegal immigrants, officials estimated. The Pew Hispanic Center, a project of the Pew Research Center, said later that?even more immigrants ? as many as 1.4 million children and young adults ? could meet the eligibility requirements. That would be about 12 percent of the 11.2 million illegal immigrants estimated to be in the U.S. as of 2010.


But it's not at all certain how?many of them will seek to take advantage of the order. That's because it requires eligible immigrants to step forward and ask for the deferment every two years.

Even though President Barack Obama said Friday that the order would "lift the shadow of deportation" over illegal immigrants who were brought to the U.S. while they were children, a future administration could choose to overturn the regulation, jeopardizing those who have identified themselves to the government as illegal immigrants.

A senior administration official, who briefed reporters on the policy?Friday on?condition of anonymity,?conceded that "the executive can always change its mind about how to exercise discretion."

For Yelky Ramos, 20, a recent college graduate who came from the Dominican Republic when she was 13, the change means she should be able to get a job.

"We just hope that the way they're going to implement it is going to be fair to the undocumented youth and it won't be a trap, in which people will be applying for this type of deferral and then find themselves ? (in) legal proceedings that might lead to deportation," Ramos told msnbc.com.?

Even before Obama appeared in the White House Rose Garden to discuss the order Friday afternoon, Democratic campaign officials were?trying to place responsibility for any such "trap" on Republicans, sending reporters "talking points" highlighting previous statements on immigration by Mitt Romney.?

Romney, the presumed Republican presidential nominee, has said he would veto an immigration bill known as the DREAM Act, which would enact many of the policies the White House announced Friday. The measure has passed in the Democratic-led House but has been blocked in the Republican-led Senate.

The memos were meant to get the message out that a vote for Romney ? who trails Obama by a significant margin among Latino voters ? would be a vote to rescind Friday's order.

DHS Secretary Janet Napolitano told NBC News that there was no immediate danger of applicants' being targeted for deportation, saying?the?order would be binding for the next two years regardless of who is president. That means Romney, if elected in November, could overturn it as early as 2014, however.

Rep. Charles Gonzalez, D-Texas, chairman of the Congressional Hispanic Caucus, praised Obama on Friday for "taking action to avoid further injustices against young people."?

But "a legislative remedy is still needed," he said.

Until one emerges, illegal immigrants must meet a narrowly specific set of requirements to be eligible for immunity, which DHS outlined in an eight-page document Friday:

  • They must be younger than 30.
  • They must have been brought to the U.S. before their 16th birthdays.
  • They must have been in the country for five continuous years.
  • They must have no criminal history.
  • They must have graduated from an American high school, earned an equivalent degree or served in the U.S. military.
  • They must pass a government background check.

North Carolina tries to outlaw climate models

Political satirist Stephen Colbert's solution to unfavourable climate science is simple: "If your science gives you a result that you don't like, pass a law saying that the result is illegal. Problem solved."

Legislators in North Carolina are apparently of the same mindset. When a state-appointed commission announced that North Carolinians could expect 39 inches of sea-level rise by 2100, the Senate responded with a bill that legally prevents the Division of Coastal Management from using the climate model that forecasts fast-rising sea levels. Instead, the legislators would like to see coastal management use only a linear model, which predicts a mere 8-inch rise by the same year.

The 8-inch model, based solely on historical records from the last 100 years, flies in the face of modern climate science. Sea level rise is due to a combination of climate-driven factors: warmer temperatures cause ocean water to expand, and rising temperatures are melting the Arctic and Antarctic ice caps. The combined feedback makes for exponential ? not linear ? growth. Yet the North Carolina bill states: "Rates of sea-level rise may be extrapolated linearly to estimate future rates of rise but shall not include scenarios of accelerated rates of sea-level rise."

"This is unprecedented," says Orrin Pilkey, professor emeritus of geology at Duke University in Durham, North Carolina. "It's the first time a law has dictated the shape of a curve."

NC-20, the group behind the bill, has argued that incorporating the 39-inch predictions would be an enormous economic burden on coastal communities. "The legislature has declined to face the problem of what we're going to do about it, and instead has attacked the science," contends Pilkey.

Though the bill passed the Senate by 34 votes against 11 and seems poised to make a smooth run through the House, Pilkey and other climate scientists are hoping that the governor will veto it.

At a time when Britain is led by a government which appears unable to recognise, let alone overcome, the enormous challenges facing it, Labour needs to be outward-looking, united and engaged with the issues that matter to voters.

Over the past year, Progress has been doing its part to make that happen: through our magazine, website, and events in London and throughout the country, we have provided the opportunity for hundreds of party members to debate Labour?s future policy agenda and how to beat the Tories, Liberal Democrats and Greens, as well as providing them with practical skills and advice on how to do so.

As Ed Miliband said in his address to this year?s Progress annual conference: ?You have always been at the heart of challenging old orthodoxies and championing change.?You have given the Labour party space to think, you have challenged the party, and you have changed it.?

It is regrettable, therefore, that the GMB union conference this week passed a resolution attacking Progress. We are also deeply disappointed that its general secretary, Paul Kenny, has now announced his intention to bring forward a resolution to Labour party conference which would ?effectively outlaw Progress as a part of the Labour party?.

It is absurd to suggest a comparison between the role of Progress and that of the Militant Tendency in the 1980s. Militant were loyal to an external political force and affiliated to the 4th International; were secret about their activity; recruited people to join the Labour party to pursue Militant?s aims; and were outside of Labour?s mainstream.

By contrast, Progress is an organisation of Labour party members for Labour party members; we are open, pluralist and proud of the last Labour government and what it achieved for working people; and our events have been addressed by Ed Miliband and his two predecessors.

Progress will not be distracted by attacks or threats. For Labour to come back from its second worst defeat in 2010 it needs to be broad, pluralistic and inclusive. To suggest that there are members of the Labour party who are somehow unwelcome and should be ?outlawed? is both counterintuitive and just wrong.

Over the coming months, we will continue to focus on the issues that have been at the forefront of our work over the past year: restoring Labour?s economic credibility; promoting universal child and elderly care; and devolving power to public service users and workers, and local government.

Most importantly, we will continue to focus on the election of a Labour government in 2015 under Ed Miliband.

Inaccuracies in the GMB resolution are listed below:

  • There is no relationship between the funding we receive from Lord Sainsbury and the funding that he gave to the Labour party. Our annual income from him was ?250,000 until May 2010, when it was raised to ?260,000. This was before he ceased giving money to the Labour party and our income from Lord Sainsbury has not been increased (as the resolution implies) as a result of that decision.
  • To suggest, as this resolution does, that our only financial relationship is with a pharmaceutical company is, to say the least, misleading. Like other centre-left organisations and thinktanks, we rely on sponsorship to support our events programme, particularly at Labour party conference.? While it is true that Progress received sponsorship from Pfizer/Pharmacia (it is one company, the former took over the latter) for a series of events (including a Scottish conference, Progress annual conference and a reception at Labour party conference) we have received no sponsorship from them since 2005. As our website states, in 2010-2011, we worked with the following sponsors: Community union; unionlearn; The Cooperative Group; Brighton and Hove Labour; City&Guilds; the Electoral Reform Society; The European Azerbaijan? Society; Hackney Labour Group; Institute for Government; IPA; Labour Friends of Israel; Bell Pottinger; Local Government Association Labour Group; PwC; Reading Labour; Sussex Cooperative party; The Open University; and Unions21.
  • There is no evidence whatsoever for the claim that ?Prominent Progress members have briefed against Ed Miliband to the press.?
  • Progress publicly endorsed the Labour candidate in the London mayoral election; organised six campaign days in the capital throughout the first five months of the year;and ran a double-page spread ? ?The case for Ken? ? by Tessa Jowell, Livingstone?s then campaign manager in our April 2012 edition. To wilfully misconstrue a debate in the magazine last year about Labour?s chances of victory as opposition to its candidate is uncomradely.

    Group B streptococcal meningitis has long-term effects on children's developmental outcomes

    ScienceDaily (June 12, 2012) ? Parents of infants who survive bacterial meningitis caused by group B Streptococcus might have to live with the effects of the disease on their children long after they're discharged from the hospital.

    A new study in the journal Pediatrics finds that even though mortality rates of children infected with GBS meningitis have decreased in the past 25 years, just under half of children who survive the disease will suffer impairment as a result of the disease.

    "These bacteria can quickly cause significant damage to the developing infant brain very quickly despite the infant's having received excellent medical care," says Morven S. Edwards, M.D., professor of Pediatrics at Baylor College of Medicine and a co-author on the paper. "This is a potentially devastating illness and we still have a large percentage of infants who have poor outcomes after the infection."

    According to the CDC, 25 percent of pregnant women carry GBS. It is routine for these women to receive antibiotics during labor to protect the baby from infection occurring in the first days of life. There is no way to prevent late-onset GBS infections in infants.

    "We haven't had recent data on the outcomes of GBS meningitis in over 25 years and the quality of medical care has changed," says Prachi Shah, M.D., a clinical assistant professor at the University of Michigan Medical School Department of Pediatrics and Communicable Diseases, and a senior author on the paper. "We wanted to know, in this era of using antibiotics during birth, whether outcomes have changed for infants who do acquire GBS meningitis. Our study counsels families to be very vigilant about their child if they've had GBS."

    The current study shows that, although modern day medicine has improved survival rates, children can still suffer adverse long-term outcomes.

    "Despite the fact that mortality has decreased in the last 25 years, survivors of GBS meningitis continue to have substantial long-term morbidity," says Romina Libster, M.D., a physician in the Department of Pediatrics at Vanderbilt University and first author on the paper.

    The overall impact of invasive GBS infection in infants is just over 2,000 cases per year in the United States. Among those with bloodstream infection, 10 to 20 percent can also develop meningitis.

    The relative importance of GBS as a cause of meningitis has grown in recent years. "GBS is responsible for over 85 percent of bacterial meningitis in children under two months of age," says Edwards. "Vaccination with the newer pneumococcal vaccines has led to tremendous reductions in meningitis from those bacteria."

    Using three different and distinctly defined levels to measure functionality, researchers find that 56 percent of children who survived GBS meningitis went on to have age-appropriate (or normal) development, 25 percent had mild-to-moderate impairment and 19 percent had severe impairment.

    Signs of mild-to-moderate impairment include continual and significant academic underachievement as well as evidence of mild neurological or functional impairment. Indications of severe impairment include blindness, hearing loss, cerebral palsy, and significantly delayed development.

    According to lab data and cranial images at the time of discharge, there are a number of factors that can help predict the likelihood of long-term severe impairment in GBS meningitis survivors, including a failed hearing screening, an abnormal neurologic exam, and abnormal imaging of the head. However, data and imaging cannot as accurately predict children who will have mild impairments, according to the study.

    "The more subtle developmental delays suggest that any child who has had GBS meningitis should have ongoing developmental evaluation," says Edwards, "so that problems can be identified early and addressed even before the child actually starts school so that the child has the best chance to fulfill their potential."

    The study examined 43 survivors of GBS meningitis between the ages of three and 12 years. Patients were examined physically, neurologically, with hearing and vision screening, and were also assessed using standardized developmental assessments.

    Parents were also questioned on perceptions of their child's development. Parents of children who either had normal or severely impaired functionality are able to accurately identify their children as such. However, according to the report, parents of children with mild-to-moderate impairments are less likely to accurately label their child's developmental delay. Because of this, Shah suggests the importance of follow-up evaluations. "Parent self-report is not always an accurate identifier of children who have mild impairment," she says, "which is why survivors of GBS meningitis should receive long-term development surveillance."

    According to Edwards, there are two important steps to be taken moving forward. The first is the development of a vaccine for mothers so that the disease can be prevented altogether. "The other," Edwards says, "is just to enhance awareness of the consequences of the infection and of the need for its prevention."

    Currently, clinical testing is already underway for a GBS vaccine developed by Novartis Vaccines & Diagnostics.
